CIVIL ATTORNEY
In 2001, Andrew W. Dodd, J.D. will celebrate 30 years of having his own private practice in Torrance, California. Since 1991, he has served as Director-At-Large/Co-Chairperson, Vaccine Litigation Group, Association of Trial Lawyers of America.
Mr. Dodd has been admitted to practice in the Supreme Court of the State of California; the United States District Court - Central and Eastern District(s) of California; the United States Tax Court; and the United States Court of Federal Claims.
He is a member of the following: Association of Trial Laywers of America; The State Bar of California, License #46293; The Los Angeles County Bar Association; Phi Alpha Delta Law Fraternity; and The Los Angeles Country Club.
EXPERTISE AND EXPERIENCE IN D.P.T. RELATED LITIGATION
Mr. Dodd has devoted in excess of 13,000 hours, personally, to traditional pharmaceutical products litigation involving the product D.P.T. over the nine (9) years ended 1990, approximately 90 percent of his professional career during that period.
In addition to appearing as counsel in numerous lawsuits involving the product D.P.T., Mr. Dodd was lead counsel in two (2) landmark decisions concerning the product D.P.T., Hurley vs. Lederle, et al., 651 F. Supp. 993 (E.D. Tex. 1986), rev. 851 F2d 1536 (5th Cir. 1988) , and Morris vs. Parke, Davis & Co., et al., 667 F. Supp. 1332 (C.D. Cal. 1987), see also 573 F. Supp. 1324 (1983), cases of national importance. Mr. Dodd also appeared as lead counsel for Amicus in Flood v. Wyeth Laboratories, Inc., 228 Cal. Rptr. 700, 183 C.A. 3d 1272, (App. 2 Dist. 1986), the leading case in the State of California on the subject of pharmaceutical manufacturer immunity from D.P.T.-related litigation.
Mr. Dodd is currently co-counsel with respect to a pending Writ of Certiorari before the United States Supreme Court, Michele Y. Terran vs. Secretary of Health and Human Services, No. 98-5161 (Dec. 1999).
In Terran, supra, Mr. Dodd seeks to overturn various restrictive changes to the National Vaccine Injury Compensation Program undertaken by the Secretary of the Department of Health and Human Services and, further, seeks to further define the scope of Daubert-type limitations on expert witness testimony.
As part of his preparation in this field, Mr. Dodd has read, personally, in excess of two hundred medical journal articles on the subject or pertussis vaccine, its composition and manufacture, and on associated scientific subjects.
In addition, Mr. Dodd has read, personally, in excess of 50,000 pages of pharmaceutical manufacturer records related to the manufacture, storage and shipment of D.P.T. vaccine.
LEGISLATIVE EXPERIENCE
Mr. Dodd was one of the two attorneys representing children who testified in support of the "Hawkins-Hatch" Bill, the predecessor to the National Vaccine Injury Compensation Program, 42 U.S.C., Section 300aa-10 et seq.
In support of this legislation, Mr. Dodd conceived, organized and chaired the committee known as Advocates for a Safe Vaccine, the group which produced for the United States Congress the report "D.P.T. Vaccine: Interim Report".
The leading lay publication on the subject of D.P.T. vaccine, D.P.T., A Shot In The Dark (Harcourt Brace Jovanovich, 1986), was written in memory of Julie Middlehurst-Schwartz, a three-year old D.P.T. vaccine victim whom Mr. Dodd had the honor of representing.
Mr. Dodd is mentioned in said publication ("Acknowledgments", page viii) as one of the attorneys acknowledged for his work on behalf of vaccine-damaged children.
On July 23, 1991, the Secretary of the Department of Health and Human Services, by and through his attorney, the Department of Justice, acknowledged Mr. Dodd as " . . . one of the most experienced practitioners under the (National Vaccine Injury Compensation) Program . . ."
